F.A. No. 317 of 2019

           Learned counsel for the appellant in FAO No. 284 of 2019 is absent but learned counsel for the Respondent-insurer and complainant are present.

2.        The complainant himself, being appellant in F.A.No. 317 of 2019 is present. In this appeal also Respondent insurer in F.A.284 of 2019 is also present but Respondent-Bank is absent.

3.        It is a matter of 2019 and the matter has been lingering due to inaction of the appellant-bank. Therefore, the appeal no.284 of 2019 is dismissed for non-prosecution.

4.        In appeal no. 284 of 2019, if  the impugned order is complied, then the complainant who is respondent has nothing to say. In such situation, the appeal No.317 of 2019 is disposed of as not pressed.

5.        The impugned order should be complied with within 45 days failing which necessary execution proceeding be started by the complainant against the erring opposite party.  

DFR be sent back forthwith.
