Today is fixed for hearing and filing of calculation sheet by the J/dr.

The J/dr. files hazirah and also files Statement of Account.  The Bank Manager of the J/dr./Bank is also present.

The D/hr. takes no step.

Perused the case record.  It reveals from the case record that the J/dr. paid the decreetal amount in favour of the D/hr. and the D/hr. received the amount by signing on the order sheet.  Accordingly, we do not find any ground to proceed with this execution case.  Hence, this execution case is hereby dropped accordingly.

Later –

After passing of the above order, the D/hr. files his hazirah and is present and submits that he did not get the amount as per order passed by this Forum.  Let the hazirah be kept with this case record.
