This complaint has been filed before DCDRC, Chennai (North) in CC.No.38/2019, transferred to this commission by the order of the Hon’ble State Consumer Disputes Redressal Commission, Chennai and taken on file in CC.No.58/2022.
The complaint was filed by the complainant under section 12 of the Consumer Protection Act 1986 alleging deficiency in service in not crediting deposited money in his Saving Bank Account No.332902010043390 along with a prayer to direct the opposite parties to pay a sum of Rs.2,00,000/- towards compensation for the mental agony and hardship caused to the complainant.
No representation for complainant inspite of service of notice on 11.07.2022. Proof affidavit not filed by the complainant. Sufficient opportunities given for filing Proof affidavit and for appearance on 15.07.2022, 05.08.2022, 24.08.2022, 13.09.2022, 20.09.2022, 26.09.2022, 17.10.2022, 31.10.2022, 08.11.2022 and on 22.11.2022. In spite of the same, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file. Hence the consumer complaint is dismissed for non prosecution. No cost.
This order was pronounced by us in the open Commission on this 22nd November 2022.
