(1)The case of the Complainant is that the Complainant is a cultivator and had applied for establishment of small diary under Dairy Entrepreneur Development scheme which is duly sanctioned in the year 2017-2018. The union Bank of India/Opposite Party had sanctioned a loan of Rs. 2,70,000/-(Rupees two lakh seventy thousand)only bearing loan Account No. 491006050000109 in which a subsidy of Rs. 75,000/-(Rupees seventy five thousand)only was sanctioned to the Complainant. The Complainant had prayed for release of subsidy amount in his favor but the Opposite Party had not taken any step. At last, on Dt. 17/10/2022 a written application was sent to Opposite Party to release the subsidy but no action. A written application was also sent to V.S. Bargarh but the Complainant has not got the subsidy amount. For the deficiency in service of the Opposite Party the Complainant filed Complaint before this Commission.
(2)The case of the Opposite Party is that the Opposite Party did not appear before this Commission, Hence set exparte.
(3)After perusal of the documents filed by the Complainant as well as oral submission it reveals that the Complainant had availed a loan amount of Rs. 2,70,000/-(Rupees two lakh seventy thousand)only from the Opposite party on Dt. 24/08/2017 under DEDS for which 25 (percent) subsidy under central plan has been sanctioned amounting to Rs. 75,000/-(Rupees seventy five thousand) only. The information regarding subsidy amount has also been reflected in the letter Dt. 27/07/2017 to the Opposite Party by Deputy Director, Dist. Vertinary Hospital, Bargarh. The Opposite Party after due receipt of notice did not appear before this Commission and was set exparte and accordingly the Complaint petition is not disputed. The Complainant has communicated to the Bank/OP to release the subsidy amount but the Bank/Opposite Party did not respond, it is the duty of the Opposite Party to release the Subsidy amount of Rs. 75,000/-(Rupees seventy five thousand) only in favor of the Complainant. The act of non releasing the subsidy amount of Rs. 75,000/-(Rupees seventy five thousand) only amounts to deficiency in service on the part of Opposite Party.
Accordingly, it is Ordered.
O R D E R
The Complaint is allowed exparte against the Opposite Party. The Opposite Party is directed to deposit the subsidy amount of Rs. 75,000/-(Rupees seventy five thousand) only along with Rs. 20,000/-(Rupees twenty thousand) only for mental harassment and Rs. 5000/-(Rupees five thousand) only towards litigation expenses to the Complainant with in one month from the date of this Order. Failing which the entire order will carry 9% intrest P.A. till realization.
