Today is fixed for further hearing and delivery of final order.
OP Nos. 1,2 & 3 files hazira through the Ld. Advocate. No step is taken by the complainant. On repeated calls, none appeared on behalf of him.
Perused the case record. It appears that showcause was caused earlier to the complainant for non-taking step for a long time and it appears that thereafter he again has been absent without intimation since long.
Under the above facts and circumstances, we are of opinion to s ay that the complainant is not willing to proceed with the case further. Accordingly, as per provisions 13(2)( C ) of the Consumer Protection Act, 1986, an appropriate order in this case can be passed.
Hence, it is
ORDERED
that the case be and the same is hereby dismissed for default.
Let a copy of this order be given to the parties on free of cost.
