Today is fixed for S/R and appearance of the OPs and hearing of M.A. case being No. 02/2023 in presence of both sides.
Complainant files hazira through the Ld. Advocate.
Ld. Advocate , claiming to be the Advocate of the OP, has filed a petition for time on the ground of illness.
The petition has been shown to the Ld. Advocate for the complainant who raised objection.
The Ld. Advocate for the OP appeared on 10.02.2023 with an undertaking to file Vokalatnama and W/V but till now he did not file any Vokalatnama or W/V.
In this situation, the M.A. case being No. 02/2023 u/S 38(8) of the C. P. Act, 2019 is taken up for hearing.
Heard the Ld. Advocate for the complainant. Perused the petition u/S 38(8) of the Consumer Protection Act, 2019 supported by an affidavit and the documents so filed by the complainant.
It appears that the complainant alleged that the OP Bank has illegally freezed her Salary Account of without any reasons and without giving any notice to the complainant for which she is not able to operate her salary account to meet up her minimum requirement for some months.
The complaint filed by her also discloses the same.
The complainant also sent a legal notice in respect t of the same to the Bank, requesting to un-freeze the said account. That apart, the bank also used to deduct some amount from the salary account of the complainant, though she did not take any loan from the Bank concerned. She also fixed Xerox copies of minutes of the meeting of the locality wherefrom it appears that the complainant did not take any loan from the bank concerned , though other persons were willing to take loan. One letter addressed to the B.D.O, Bhatar, is also filed.
Under the above facts and circumstances, we are of opinion that there is a prima facie case to issue Interim Order.
Accordingly, it is
ORDERED
that the OP -U.C.O. Bank, Bhatar Branch, is hereby restrained from freezing the Salary Account No. 08560110041253 of the complainant so that the complainant can withdraw the salary from her Salary Account to meet up her minimum requirements to maintain her family till the disposal of the case.
M.A. Case being NO. 02/2023 is thus disposed of.
Let a copy of this order be given to the complainant on free of cost.
Complainant is directed to file compliance report immediately.
Fix 20.03.2023 for filing Vokalatnama and W/V, etc by the OP and further order.
