Record is put up today by a petition filed by complainant Sasthi Charan Sinha on 08.09.2015 , next date was fixed on 20.11.2015 for filing written version by the OP No.1 and 2. The OP No.1 appeared by Branch Manager, Biswajit Mondal on 20.11.2015 and prayed for time to file written version. Despite receiving notice the OP No.2 did not turn up. So next date was fixed on 05.01.2016 for filing written version by OP No.1 and appearance of OP No.2.
The case of the complainant is that he being a retired employee invested a sum of Rs.4,20,904/- before the OP No.1 and two investment certificates were snatched by the OP No.2 so he prayed before the OP No.1 to issue duplicate certificates of two FDs. But the OP No.1 did not pay the matured value of the FDs or issued duplicates. The OP No.1 issued a letter to the Complainant to present the original FDs otherwise the payment will not be possible for them. At this juncture the Complainant getting no alternative filed the instant complaint before this Forum for getting the investment proceeds from the OP No.1 and other reliefs.
Today on 30.12.2015 the complainant filed a put up petition to put up the record so that complainant can withdraw the complaint petition as the dispute in between the parties has amicably settled. And there is no necessity to continue the proceeding further. He prayed to dismiss the complaint petition for non-prosecution otherwise he will suffer irreparable loss. The said petition was verified by his Ld. Advocate and it is kept with record.
After perusing the case record and the petition that filed by the complainant today we find that there is no impediment to dispose the complaint petition due to prosecution and the OPs are exonerated from any liability.
Thus the case is disposed of due to non-prosecution.
