Aforesaid Complainant filed this case against the aforesaid O.P praying for hand over the loan argrement, to return the title documents as deposited by said Abdul Rafique, compensation amounting to Rs. 1,00,000/- and other reliefs.
Complainant No. 2 and Ld. Advocate for the Complainants are present. Mr. Amal Kanti Ganguly, Ld. Advocate for the O.P is present.
During hearing Ld. Advocate for the O.P submits that their total claim amounting to Rs. 20,26,711/- as on 30/04/2016 subsequently interest have been accrued.
So, the claim value is more than Rs. 20,26,711/-.
Case is placed before this 3rd National LOK ADALAT.
During hearing Ld. Advocate for the O.P submits that in the year claim was settled to Rs. 10,00,000/- and predecessor of the Complainants gave cheque of Rs. 10,00,000/- which was subsequently bounced due to insufficient fund. Subsequently predecessor of Complainants paid Rs. 5,00,000/- by cheque on 10/02/2016 and same was encashed.
After thorough discussion it is settled that Complainants will pay Rs. 5,00,000/- in favour of the O.P and O.P is accepted the same. So, claim amount is settled as on this day at the Rs. 5,00,000/- to be paid by 30/06/2025 and Complainants will pay Rs. 50,000/- (fifty thousand) per month within the last day of the month commencing from September 2024 and it will be completed on June 2025.
Complainants shall bound to pay Rs. 50,000/- (fifty thousand) per month commencing from September 2024 and last amount of Rs. 50,000/- (fifty thousand) within June 2025.
Complainants shall visit the bank and pay the said amount under proper receipt. Ld. Advocate for the O.P submits before this Lok Adalat that he has contacted with the bank authority and took their verbal approval over phone, so regarding settled amount no dispute will arise in future.
Hence it is,
ORDERED
That the dispute is settled today with the aforesaid observation. It is made clear that dispute is settled with the amount of Rs. 5,00,000/- (five lakh) payable by the Complainants in favour of the O.P. and Complainants shall pay Rs. 50,000/- (fifty thousand ) per month commencing from September 2024 and it will end in the month of June 2025. Both parties are directed to obey this order.
Returned the case record to the Commission.
