              The parties are ready by filing haziras. Today is fixed for hearing of the case. Hd. Ld. Lawyers for both the parties. Perused the claim application and the W/o.

              In present case the complainant contented that he purchased a Bajaj Trekker bearing Regd. No.WB-33/8768 on 07/03/2003. The said vehicle was insured with the Op. no.1. On 02/02/2009 the vehicle of the complainant was damaged totally by some persons. The complainant informed about such damaged to the Op. and claimed the amount as per Insurance policy but that claim was not settled.

               The Op. contented that the complainant never file claim application in prescribed form. Had the complainant filed the application properly the Op. would have taken action.

                During hearing the Ld. Lawyer for the complainant admitted that here was no formal application by the complainant to the Op. Therefore, it cannot be said that the claim of the complainant was dishonoured. Ld. Lawyer for the Op submitted that the Ops. are not unwilling to process the claim of the complainant if it is made formally.

Upon such facts and circumstances, we dispose of this case with liberty to the complainant to file claim application in prescribed form after observing necessary formalities and if this is done by the complainant, the Op. shall accept the application and settle the claim of the complainant within 30 days of the receipt thereof. The complainant is given the liberty to approach this Forum if he feels aggrieved by the decision of the Op. with regard to the claim.

                    Thus, this case is disposed of.
