Complainant Smt. Rampati Devi filed this case with a claim for Medical treatment for Rs. 1673/- and compensation of Rs. 10,000/- and litigation cost of Rs. 10,000/-.
2 Complainant has filed this case for realization of Rs. 1,673/- against the medical bill. It is submitted that complainant has invested of Rs. 1,673/- for purchasing medicine, original bill for the said purchase receipt has been submitted to E-Meditek O.P. No.1. It is further submitted that she has been advised to purchase of the medicine as per advice and prescription by Bokaro General Hospital. It is further submitted that the petitioner and her husband was facing health problem and admitted themselves in B.G. H. Sector-4 B.S.City on 24.03.2015 and diagnose for treatment and discharged on same day. Complainant has been prescribed some medicines which were not available in B.G.H. and as such complainant has purchased the medicine from Durga Medical Store at Sector-4 B.S.City on payment of Rs. 1,673/-.
3 It is further case of the complainant that she had submitted bills to the O.P. but the O.P. has repudiated the claim of the complainant as such this case has been filed.
4 O.P. has appeared in this case and filed W.S. The O.P. has stated that complainant was not admitted for a minimum 24 hours which is mandatory as per the policy condition, as such the amount is not payable by the O.P. O.P.No.3, apart from other ground which are not relevant.
F I N D I N G S
5 Heard the parties and perused the record. We find that complainant is beneficiary under the group Mediclaim insurance policy No. 351200/46/850000207 between SAIL and Insurance Co. and premium was paid as such she is consumer.
Further the case has been within the limitation under the consumer protection Act.
6 complainant has submitted his claim before the O.Ps. for Rs. 1673/- which has not been paid on the ground that complainant was not admitted in hospital for more than 24 hours. But it is not necessary to confine 24 hours of treatment was over. The amount appears to be genuine as so it is meager amount. . However, we hold that some sort of harassment the complainant had met for which O.P. has to compensate.
7 Therefore, we direct the O.P. to pay the claim of Rs 1,673/- (Rs. One thousand six hundred seventy three) and Rs. 2000/- (Rs. Two thousand) only as compensation for mental agony and harassment and Rs. 500/- (Rs. Five hundred) only for litigation cost. The amount must be paid with 60 days from passing of this order, failing which rate of interest shall be enhanced 10% per annum till realization.
