JUDGMENT
The facts of the complaint in brief is that the complainant has purched a Tata Pickup vehicle through finance from the O.p 2 and paid Rs.70,000/- towards the initial payment. The O.p 2 took the signature of the complainant on the papers dotted line and assured that he is getting the finance without any interest and the balance amount of Rs.4,00,000/- has to pay in 60 installments i.e. within five years. The O.p 2 has not supplied the copy of agreement or the account statement and kept him in cark and when the O.ps have not used the blank cheques for collection of the EMI and regularly coming and collecting the amount without returning the cheese kept with them with the signature of the complainant. The complainant has so far paid more than Rs.2,50,000/- towards the dues and due to the carelessness of the O.P 2 to intimate the balance amount there was delay in payment of the balance money. Hence, prayed to direct the O.ps to submit their account statement and award cost of litigation and such other relief as the forum deems fit and proper.
Being noticed by this forum the opposite parties neither appeared ;nor filed any written version as such the O.ps were set exparte and in absence of any written version from the opposite party we proceeded the matter exparte and believed the allegations of the complainant and hence, we passed the order and dispose of the matter with the following directions.
ORDER
The opposite parties are directed to supply the account statement and pay compensation of Rs.5,000/- for mental and cost of litigation Rs.500/- to the complainant within one month from the date of receipt of this order, failing which the O.P is liable to pay interest @ 12% p.a. on the above awarded amount till the date of payment.
