          Heard from the respondent.

          The appellant not present. The learned advocate for the respondent submitted that the complainant was an auction purchaser of Tractor and Trailer bearing Registration No.KA-30/T-346/347. Subsequently they made representation for transfer of the ownership to RTO authority on 28-12-2012. Accordingly the complainant changed the RC into his name as per Ex.R10. The RTO has changed the name of the owner effective from 28-2-2013, but the complainant alleged the deficiency of service in delay in changing the RC in transferring registration certificate and filed the complaint before the District Commission whereas the District Commission dismissed the complaint. There is no delay in issuance of the latter to RTO by this Opposite Party and dismissing the complaint against which the complaint before this Commission and submits there is no any deficiency of service on their part and prays for dismissal of appeal also.

          On going through the certified copy of the order and memorandum of appeal and documents produced before the District Commission, we noticed here that the complainant has auction purchaser of Tractor and Trailer and made representation for change of name in the RC accordingly as per Ex.R6 this respondent letter dated 28-12-2012 sent request for change of registration in favour of complainant. Accordingly the RTO authority have changed RC into name of complainant dated 28-2-2013, we found there is no delay in sending the letter to the RTO for transfer of the RC in the name of complainant. The District Commission has rightly appreciated the evidence of both parties and dismissed the complaint, we found there is no any merit in the appeal at the same time the appellant not present since from long time. Accordingly the appeal is dismissed.         

          Forward copy of this order to both parties as well as concerned District Commission.
