        Complainant Mohan Chandra Bemal has filed this case u/s 12 of the CP Act-1986 alleging deficiency of service on the part of Opposite Parties for non-payment of his crop insurance amount in spite of his repeated approaches and praying therein for direction to the Opposite Parties to pay his crop insurance claim along with up-to-date interest and compensation.

1.         Brief fact leading to the case is that the complainant had insured his paddy crops with OP No. 2 and 3 on payment of Rs. 7,586.30p as premium and the insured amount was Rs. 3,79,315/-. In the Kharif Year-2017, village Tarbod was affected and the complainant did not receive his insurance claim in respect of damage even though the co-villagers availed their crop insurance. Since the insurance benefit was not released, he contacted the OPs time and again and as the OPs did not respond, he took the shelter of this Forum for the reliefs as discussed in the preceding paragraphs.

2.         After receipt of notice, the Opposite Parties appeared and filed written statements separately.

3.         The OP No. 1 in his written statement stated that the complainant is an account holder of his Bank and he has not insured his crops through SBI Nuapada Branch. A sum of Rs. 59768/- has been transferred by NEFT by the Insurance Company on 05.10.2018 and it has been credited to his account. When he has got his insurance claim and the OP No. 1 credited it into his account, the question of deficiency in service does not arise.

4.         The OP Nos. 2 and 3 in their written statement have stated that they are not the agency to insure the crops in Nuapada District. So, they are in no way responsible for non-payment of the dues of the complainant and they have not received any premium from the complainant. Therefore, the case against them be dismissed with costs.

5.         It is seen from the documents filed by the OP No.1 that a sum of Rs. 59,768/- has been credited to the account of the complainant on 05.10.2018 by way of transfer from the Insurance Company. Even though the complainant has complained for higher amount, he has not filed any document or has adduced any evidence to support his claim. Since the claim amount has already been paid to the complainant, as per the norms of the Central and State Government, the complainant is not entitled to any further claim and hence the order.

O R D E R

          The complaint petition is dismissed on contest. Parties to bear their own cost.
