Today is fixed for S.R. / A.D.
Complainant is present by filing his hazira.
On the other hand one letter no.BM/2017 -18 / 05 dated 08-08-2017 sent by Branch Manager, S.B.I., Hari Gram, Goenka More Branch (Code – 09699) / O.P. is received.
Perused the same.
It appears that O.P. / Bank has stated in said letter inter alia that this Complainant Mr. Sudarshan Deogharia has already received amounts for Rs.5,000/- and Rs.1,000/- (Total Rs.6,000/-) respectively on 18-07-2017 and he has no complaint against O.P. / Bank.
Complainant is present by filing his hazira and files a petition stating inter alia that O.P. / Bank has made payment of disputed amount, so he does not want to proceed with this case and prays for dismissal of this case.
None appears for O.P. / Bank.
In view of above facts & circumstances we find that Complainant does not want to proceed with this case as O.P. / Bank has paid the entire amount to Complainant. O.P. / Bank has also intimated said fact to this Forum by sending letter no.BM/2017 – 18/5 dated 08-08-2017.
In view of above facts & circumstances we do not said any impediment to allow the prayer made by Complainant and to dismiss this petition of complaint on the basis of prayer made by Complainant.
Hence, it is
Ordered
That the Consumer Complaint no.52 of 2017 filed by Sudarshan Deogharia against Branch Manager, S.B.I., Hari Gram Goenka More Branch, Dist. Bankura be and same is hereby DISMISSED FOR NON PROSECUTION ; BUT WITHOUT COST.
