Final Order / Judgement

 

            Heard the learned counsel appearing for the parties.

            This is an applicant for condoning the delay of 121 days in preferring the accompanying appeal. The applicant has explained the delay in para 14,15 and 16  of the condonation petition. It is submitted by Mr. V.K. Barooah, learned counsel appearing for the respondent that he has no objection in condoning the delay.

            Considering the statements made in the application, more particularly statements made on oath at paragraphs 14,15 and 16 and also upon submission made by Mr. Barooah, learned counsel, appearing for the respondent, delay in preferring the connected appeal is condoned.

            Misc Case is allowed and disposed of accordingly.
