Heard Mr. M. Choudhury, learned counsel, appearing for the appellant. Also heard Mr. V.K. Barooah, learned counsel, appearing for the respondent.

         Perused the petition filed on behalf of the appellant. It has been stated that the present appellant (impleaded after the death of original appellant) has decided to accept the cheque for Rs. 44,677/- deposited by the respondent bank in the District Forum as full and final settlement of her claim. She has also submitted that in view of the above position, she is not willing to proceed with the present appeal and prayed that the matter may be closed.

         Prayer so made is allowed.

         In view of the above, the instant appeal is disposed of on withdrawal.
