Final Order / Judgement

 

  1. The complainant having a PPF account being no. 35376095112 on 03.12.2015 with SBI, Nagarbazar branch and kept on regularly depositing annual subscription till the financial year of 2018-19. But on 12.12.2019 when the complainant want to deposit the subscription for the financial year of 2019-20 she was not allowed to do so on the ground that her PPF account turned out to be irregular for want of deposits being made in the last 3 consecutive financial years. The complainant thereafter requested the bank authority to regularize her PPF account by sending letter on 27.12.2019, 30.12.2019 and 17.01.2020. That apart Rs. 150 was deducted from her bank account as penalty charges. With prayer for regularization of her PPF account and also for getting compensation, litigation cost and other reliefs she has filed this case against the SBI and his Deputy Manager, Aashish Mukhopadhayay.
  1. In support of her case the complainant has filed copy of letters dated 27.12.2019, 30.12.2019, 17.01.2020 in addition to copy of her passbook for her PPF account. The letters have not been challenged by the other side. It has also not been challenged by the other side that Rs. 150/- was deducted from the complainant’s account as penalty charges.
  2. But during the course of argument the Ld. Advocate appearing for the OPs has contended that due to some technical reasons the deposits made by the complainant during the financial year of 2015-16, 2016-17, 2017-18 and 2018-19 could not be visualized on internet for which erroneous information about irregular account was conveyed to the complainant and Rs. 150/- was deducted from her savings account as penalty charges. After making reference to the letter dated 24.01.2020 which was issued by the bank authority to the complainant has contended that Rs 150/- has been refunded by crediting to the complainant’s savings bank account being no. 37608099790 and the branch manager said sorry to the complainant. The story as to non-appearance of the deposits made during 4 financial years of 2015-16, 2016-17, 2017-18 and 2018-19 has not been disputed by the other side. Rather it has been asserted by the OP that due to some technical reasons such non-appearance had taken place and the complaint has properly been addressed. It is now crystal clear that the complainant is no longer entitled to the grievance as set out in the original complaint. That apart the bank has said sorry to the complainant for the technical fault of the system in vogue for running its business. We do think that the complainant had won the case the moment she received letter dated 24.01.2020 from the bank authority. She got the requisite materials to placate her grievance from the aforesaid letter. The case was filed on 27.02.2020 and before that she had received repentance letter from the bank. She should have dissuaded herself from filing the case in the face of such development. Since her account has been regularised and since the other side has sent repentance letter to the complainant on 24.01.2020 we do not think that the complainant is entitled to something more. There is no need to pass any order for regularization of the account or for payment of compensation or for other reliefs.

The case is thus disposed of on contest, but without cost.

Let a plain copy be given to the parties free of cost as per CPR.
