Both parties file hazira through Advocate.
The case is fixed for argument.
After hearing argument/written argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that being an ICDS worker she has an S.B. A/c No. being 33139929804 with O.P No.1/Bank having the facility of both Debit Card and Credit Card. On 29/05/2023 her Account showed a debit transfer of Rs.5,000/- in each three successive Payzapp transaction with further ATM/POS deductions. The matter was reported to the O.P./Bank Authority for such unauthorized transaction and withdrawal of money from the Account of the Complainant but getting no relief the Complainant has therefore approached this Commission for appropriate relief.
Both O.P. No.1/Bank and O.P. No.3/SBI Credit Card Authority contested the case by filing a separate written version. The defence of O.P. No.3 is that the Complainant operated the transaction by using her Credit Card in due process after sharing OTPs for the respective transactions of 5,000/- each and as such she is not entitled to get any benefit in this case.

Similar defence has been taken by O.P. No.1/Bank to the effect that the Complainant withdrew money by using her Debit Card through ATM and POS and as such she is not entitled to any relief in this case.
-: Decision with reasons:-
Having regard to the facts of the case, contention, submission, and documents on both sides the Commission finds that there is sufficient proof of operation of transactions by the Complainant by using Credit Card and Debit Card and the Complainant cannot now shift her own fault and negligence upon the O.P. Authority so as to get compensation illegitimately.
The Commission finds no merit in the Complainant’s case.
Hence it is ordered…….
That the case be and the same is dismissed on contest but without cost.
Both parties be supplied copy of this Order free of cost.
