Final Order / Judgement

In compliance of order passed by this Forum dated 29/11/12, the complainant personally appeared before the court today. She is heard on the matter of amicable settlement that was effected in between the sides. The complainant verbally informs this Forum that whatever grievances she had earlier that has been addressed to by the Opp. Party SBI, Dudhnoi Branch, and the matter have been amicably settled and now she does not intend to continue with this proceeding and she verbally prays to this court to dispose of the matter treating the same to have been compounded.

I have heard learned counsel from both sides. It appears that on the last date, a petition was moved by the learned counsel representing the complainant, intimated this Forum that the matter in dispute had already been sorted out amicably with the opp party outside the court and the complainant is not willing to proceed with her case anymore and in that premises, the learned counsel representing the petitioner prays to this Forum to dispose this matter. Upon hearing, it comes to light that she has effected a compromise with the Opp. Party SBI, Dudhnoi Branch and whatever claims she has had at the time of filing this complaint petition before this Forum that has been settled by the Opp. Party and now she is willing to proceed with the matter.

Upon closer perusal of the case record, it appears that that opp party while filing written statement also raised the counterclaim. On this matter, learned counsel representing the opp.party has submitted before this Forum that whatever dispute that exists in between the sides that have been amicably settled. Now they are a not in a mood to pursue their counterclaim and the matter to be treated as the compromise in between the sides.

I have heard the learned counsel from both sides and upon hearing the complainant on the compromise petition, this Forum is of opinion that the matter has been amicably settled. So further proceeding, in this case, becomes redundant.
This case finally stands disposed of.
