The Complainant is absent without taking any step and on repeated calls. None appears on behalf of the Complainant. It is 12.25 P.M.

The O.P files a petition praying for further date for hearing of argument on the ground as stated therein.

Heard the Ld. Agent of the O.P. It is submitted that the Complainant might have received the duplicate cheque and therefore, not interested to proceed with the case.

It appears from the record that the Complainant was absent without taking any step on 17/04/2007 & 25/05/2007.

Today is fixed for hearing of argument and the Complainant was given last chance for appearance.

The prayer of the O.P stands rejected.

It seems that the Complainant is not interested to appear and proceed with the case and the case is liable to be dismissed.

                                That the case be and the same is dismissed for default.
