Instant complaint has been filed by the complainant u/s 12 of C. P. Act, 1986 for direction upon the OP to unlock and/or allow the complainant to operate the savings A/c No. 30391449230 and 30330166693 in the OP Bank along with compensation.
The complainant’s case, in brief, is that the complainant is a bona fide consumer of the OP bank as a savings Account holder being Nos. 30391449230 and 30330166693. The second account being No. 30330166693 is operated by complainant jointly with her husband/Biplab Roy. Suddenly on 11.11.2015 the complainant noticed that her account being No. 30330166693 was blocked and similarly on 17.11.2015 she could not operate another account also. She immediately met with the OP to know the reason behind and got the answer that both the accounts were blocked due to some reasons. Then on 18.11.20115 the complainant lodged two separate written protests to the OP Bank against this unilateral act of the OP. But the OP failed to solve the blockage. Afterwards, the complainant sent an Advocate’s letter to the OP on 12.05.2016 without getting any effect; the complainant came to this Forum for proper redress.
On the other hand the OP appeared in this case by filing written version where he denied the allegation unilaterally blockage of the accounts and explained the reason behind the blockage. The OP stated that the husband of the complainant is a clerk of All India Radio, Murshidabad and maintaining a Savings Bank account with his wife/the complainant of this case as well as the employer of him i.e All India Raid, Murshidabad also maintaining an account with this OP. The OP was informed by All India Radio, Murshidabad that an FIR has been lodged against the husband of the complainant on 21.07.2015u/s 420 of IPC due to involvement in the matter of Govt. money approximately Rs.56, 00,000/- has been embezzled /withdrawn from the OP Bank, which was find out by an inspection team on behalf of AIR Directorate vigilance Wing, New Delhi. For the sake of investigation the OP decided to block the said Savings Accounts of the complainant and her husband. Later after receiving the complainant’s letter, the OP informed the AIR Murshidabad and then removed the hold from the accounts of the complainant by a letter dt. 23.06.2016.

It is pertinent to mention that both the parties have submitted some documents in support of their case.
Perused the documents in the record, we observed that the complaint has been filed this case with an allegation of Savings Bank Account blockage by the OP and the OP appeared in this case with written version along with some documents which is evident the reason behind the accounts blockage as well as removed of blockage. We also observed that the OP wrote a letter to the complainant and her husband on 23.06.2016 informing that the blockage of savings Bank Accounts removed. So she can transact normally. So, there is no question of relief and thus the case is dismissed on merit.

Ordered
that the Consumer Complaint No. 95/2016 be and the same is hereby dismissed on merit without any order as to cost.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
