Presented by Smt. Anju Agarwal,  Member (w) :-

  1. The Case of the Complainant is that the Complainant is a bonafide and genuine customer of SBI Barpali Branch. That, on Dt. 28/06/2019, the Complainant had done a term deposit in the Bank of the Opposite Party for a Sum of Rs. 2,80,000/-(Rupees two lakh eighty  thousand)only by depositing the amount vide Account No. 38560460559 that, the term deposit was made for a period of six months having maturity value for a sum of Rs.2,88,961.00/-(Rupees two lakh eighty eight thousand nine hundred sixty one)only on Dt. 28/12/2019. That, after maturity of the term deposit the Complainant has placed his claim before the Opposite Party but the Opposite Party kept the receipt and did not pay/deposit the maturity  amount  in  the account of Complainant. The Complainant has requested the Opposite Party several times to realize the amount. That, the Complainant subsequently learnt that the said amount has been plucked away from his account playing defraud by Bank Officials and the matter was placed before Opposite Party and their higher officials and FIR was lodged on Dt. 04/02/2021. That, for the aforesaid out of the Opposite Party the was harassed physically and mentally, the Complainant filed this Complaint before this Commission.
  2. The Case of the Opposite party is that the Opposite Party has filed a petition and   stated that the Complainant has deposited the fixed deposit is admitted. The Complainant has already received the maturity amount from the Bank. The Opposite Party has filed the Bank statement for perusal. Hence, the Complainant petition is liable to be dismissed.
  3. Perused the documents filed by the Complainant (Xerox copies).
  1. Term deposit receipt Dt. 28/06/2019.
  2. Copy of FIR Dt. 04/02/2021.
  1. The Opposite Party has filed the Bank statement account of the Complainant.
  2. After perusal of the Complainant, statement of the Opposite Party and documents filed by the parties the following issues are framed :-

ISSUES:-

  1. Whether the Opposite Party is deficient in their service ?
  2. What relief the Complainant is entitled to get ?

Issue No.1:-

The Complainant has deposited on Dt. 28/06/2019 an amount of Rs. 2,80,000/-(Rupees two lakh eighty thousand)only vide Account No. 38560460559 for a period of six months having maturity value for a sum of Rs. 2,88,961/-(Rupees two lakh eighty eight thousand nine hundred sixty one)only on Dt. 28/12/2019 in the Bank of the Opposite Party filed by the Opposite Party reveals that the matured amount has been deposited on Dt.31/03/2020 in the account of the Complainant bearing Account no. 38560460559.  Where the said amount was transferred to another account bearing No. 33966897632 in the name of the Complainant. As, the Opposite Party ;has done its duty by depositing the matured amount in the account of the Complainant there lies no deficiency in service on the part of the Opposite Party.

Issue No.2:-

            The Complainant is not entitled to get any relief.

                        Accordingly it is Ordered.

O R D E R

The Complaint is dismissed against  the Opposite Party. The Complainant is at liberty to file before appropriate court of law.
