Ld. Advocate for the complainant / petitioner submits that CC/187/2020 has been filed by the complainant as a voluntary consumer association as per Section 2(5)(ii) of the Act,2019 seeking justice for one Madhudan Naskar. It is alleged that the handwriting appears in the cheque in question was not written by Madhusudan Naskar  but he signed the said cheque.

So, the said cheque is required to be examined through Questioned Document Examine Bureau (QDEB), Bhawani Bhawan, Alipore, Kolkata.

Ld. Advocate for the opposite parties submits that the matter is fixed for filing BNA and argument and complainant has preferred this application at this later stage. So, the same may be rejected.

In our opinion, to adjudicate the question raised in CC/187/2020 the cheque in question is required to be examined by the QDEB, Bhawani Bhawan, Alipore, Kolkata.

Thefefore, the Misc. Application dated 17/04/2023 is allowed on contest without cost.

Thus,  the Misc. Application is disposed of.
