Today is fixed for hearing the petition filed by the O.P No. 3. Said petition is registered as M.A 179/2024.

Ld. Advocate for the Complainant, Ld. Advocate for the O.P No. 1-2 and Ld. Advocate for the O.P No. 3 are present.

Petition dated 24/03/2023 filed by the O.P No. 3 which registered as M.A. case no. 179/2024 is taken up for hearing. Heard both sides. Perused the aforesaid petition. Also perused the W/O filed by the Complainant. Perused the objection.

The present case relating to insurance claim in respect of treatment cost.

On perusal of record we find that O.P No. 3 treated the patient and he was attached with Apollo Gleneagles Hospital. Complainant not yet impleaded that the said Hospital as O.P.

Complainant impleaded the O.P No. 3 in this case in connection with the present dispute.

On perusal of record we find that Complainant filed series of documents and we find that considerable amount was claimed from the Complainant.

At the time of final hearing there is probability of arising of varieties question including the treatment cost as well as treatment of the patient.

In this situation we think that presence of O.P No. 3 is highly essential during disposal of this case.

Accordingly we do not find any merit in the aforesaid petition filed by O.P No. 3 claiming expunge of his name.

Hence, the petition dated 24/03/2023 which registered as M.A. case no. 179/2024 is considered and rejected.

To 11/07/2024 for filing questionnaires by the O.Ps.

M.A. case no. 179/2024 is thus disposed off.
