Case record taken up today for hearing. Complainant is absent on call. Learned counsel for O.P is present. However in view of Sec 38 (3) (c ) of C.P Act, case record taken up to de3cide on merit.

Perused the material available on record. The complainant raised allegation of deficiency of service on the part of O.ps for non issue of No objection certificate to him by the O.Ps even after deposited of entire finance amount . On the other hand the O.P disputed the fact of deposit of loan dues rather it is submitted that there is outstanding loan amount due against the O.ps which the financer/O.P has not issued NOC with respect to the complainant.,

Law is well settled that onus lie on the complainant to prove deficiency in service there on the part of O.Ps. Here the complainant failed to prove any deficiency in service on the part of the O.ps.

                           On perusal of the record we have unable to hold any deficiency in service on the part of O.ps . As such complainant                                  against the O.ps is dismissed . However, no order as to cost. Case is disposed of accordingly
