                                                            JUDGEMENT

      

       The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  non issue  of NOC towards finance vehicle OR-18-A-7605   for which  the complainant  sought for redressal of the grievances raised by the complainant.

       The complainant has  filed a petition U/S- 12 of the C.P. act along with  interim petition U/S- 13-3-B of the  C.P. Act, 1986. Before the forum.

       After  hearing from the learned counsel for the complainant this forum on Dt. 16.3.2016  has  passed interim order exparte against the O.Ps directing the O.Ps not to proceed in the matter for arbitration proceeding  and not to seize  the truck bearing No. OR-18-A-7605   of the complainant  which is  under  hypothecation till final disposal of the present dispute.

       Aggrieved the above exparte  interim order Dt. 16.3.2016  the O.Ps have  preferred  revision before the Hon’ble State C.D.R.Commission, Cuttack vide R.P. No. 34 of 2016.

       During sub-judice of   R.P. No. 34 of 2016  before the Hon’ble State C.D.R.Commission, Cuttack

       the learned counsel for the complainant  has filed a memo submitted that the complainant and the O.Ps have  settled the matter out of the court and the complainant has paid the settled amount to  the O.P. on Dt.18.2,2019, and NOC has been issued in favour of the complainant towards the finance vehicle OR-18-A-7605   by the O.Ps to subside the  present dispute between the complainant & O.Ps  with full and final  satisfaction  of  the complaint  and provide proper service  and no claim further  against them from the complainant as the dispute solved  among themselves. Hence the O.P. prays the forum to dispose the case accordingly  as settled out of the court.

       Heard from the parties. During the course of hearing the O.Ps have not objected the memo filed by  the complainant.  Perused  the   record  and  memo  filed by the complainant inter alia NDC  issued by the O.Ps on Dt. 18.2.2019.  The memo is allowed.

                Accordingly the present dispute mitigated  and the  case stands disposed  off  but O.Ps wriggled out of  liabilities & the  case closed against  them    as  the  complainant   do not want to  proceed  with  the case further against the O.Ps  after settled the matter amicably out of court.  Parties are left  to bear their own cost.

                Further  the complainant in their memo submitted that the orders may be sent to the O.Ps and a copy to the R.T.O., Rayagada so that the Hypothecation endorsement in the  R.C. book of the complainant  can be deleted.

                As per  M.V. rule  at the time of issue of NDC  by  the O.Ps they  should have  issued  form-35  to the R.T.O., Rayagada  for delete the endorsement of hypothecation entry in R.C.book of the complainant.  If not issued form-35  by the O.Ps  the O.Ps are directed to issue form No. 35  to   the  R.T.O, Rayagada  to delete the endorsement of hypothecation entry  in the R.C. book of  finance vehicle Regd. OR-18-A-7605  within  7 days from the date of issue of this order.

       The complainant is directed  after receipt of the  form No.35 from the O.Ps he should contact the R.T.O., Rayagada personally for early delete the endorsement of hypothecation entry  in the R.C. book of  finance vehicle Regd. OR-18-A-7605.
