                                                            JUDGEMENT

       The  crux of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  non issue  of NOC towards TATA Motors Truck finance vehicle Regd. No. OR-18-A-4697  Model No.LPT 2525 for which  the complainant  sought for redressal of the grievances raised by the complainant.

          The complainant has  filed a petition U/S- 12 of the C.P. act along with  interim petition U/S- 13-3-B of the  C.P. Act, 1986. Before the forum.

          After  hearing from the learned counsel for the complainant this forum   has  passed interim order exparte against the O.Ps directing the O.Ps not to proceed in the matter for arbitration proceeding  and not to seize  the truck bearing No. OR-18-A-4697 of the complainant  which is  under  hypothecation till final disposal of the present dispute.                                                 P..contd…2..

          .During sub-judice of   C.C. case the learned counsel for the complainant  has filed a memo submitted that the complainant and the O.Ps have  settled the matter out of the court and the complainant has paid the settled amount to  the O.P. in turn the O.Ps have issued NOC in favour of the complainant towards the finance vehicle.  The  present dispute between the complainant & O.Ps have settled with full and final  satisfaction  of  the complaint  and provide proper service  and no claim further  against them from the complainant as the dispute solved  among themselves. Hence the O.Ps. prays the forum to dispose the case accordingly  as settled out of the court.

          Heard from the parties. During the course of hearing the O.Ps have not objected the memo filed by  the complainant.  Perused  the   record  and  memo  filed by the complainant inter alia NDC  issued by the O.Ps.  The memo is allowed.

                Accordingly the present dispute mitigated  and the  case stands disposed  off  but O.Ps wriggled out of  liabilities & the  case closed against  them    as  the  complainant   do not want to  proceed  with  the case further against the O.Ps  after settled the matter amicably out of court.  Parties are left  to bear their own cost.
