For the complainant:- Self.

For the  O.Ps. :- Sri N.N.Panda, Advocate, Rayagada.

                                                                       JUDGEMENT

The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  freeze the  account No.30596911748 of the complainant  for non payment outstanding  loan amount to the O.Ps  for which  the complainant  sought for redressal of the grievances raised by the complainant.

Upon  Notice, the O.Ps put in their appearance and filed joint written version through their learned counsel in which  they refuting allegation made against them.  The O.Ps  taking one and another pleas in the written version   sought to dismiss the complaint as it is not maintainable  under the C.P. Act, 1986. The facts which are not specifically admitted may be treated  as denial of the O.Ps. Hence the O.P No.  1 & 2 prays the forum to dismiss the case against  them  to meet the ends of justice.

During the course of hearing the  learned counsel for the O.Ps filed a memo  submitted that  the complainant  has paid  all the dues towards the loan account No. 31051029677 CC/PMEGP  to the bank   in turn the bank also has released  the documents in favour of the complainant  towards the   PMEGP loan  by the O.Ps to subside the  present dispute between the complainant & O.Ps  with full and final  satisfaction  of  the complaint  and provide proper service  and no claim further  against them from the complainant as the dispute solved  among themselves. Hence the O.P. prays the forum to dispose the case accordingly  as settled out of the court.

Heard from the parties. During the course of hearing the complainant has not objected the memo filed by  the O.P.  Perused  the   record  and  memo  filed by the O.P.  The memo is allowed.

Accordingly the present dispute mitigated  and the  case stands disposed  off  but O.Ps wriggled out of  liabilities & the  case closed against  them    as  the  complainant   do not want to  proceed  with  the case further against the O.Ps  after settled the matter amicably out of court.  Further if  any  documents are available  for security purpose  at   bank be released  in favour of the complainant immediately.  Parties are left  to bear their own cost.

Dictated and corrected by me.       Pronounced on this      27th.    Day of       February, 2019.
