Final Order / Judgement

                 This is an order  arising out of a petition  filed U/S-69 of the Consumer Protection Act, 2019 which is pending from  21/09/2020 which was  filed  on 14/09/2020 by the  petitioner - Mr Sandip Basak where it has  been  mentioned  that  cause of action  arose   on 10/04/2018 on which  date  the  opp. party sent a   letter  to the  complainant informing  about  rejection  of the  claim.  According to the  complainant   consumer  case  ought   to be  filed  within 2 years i.e.  on or  before 09/04/2020 but due to  Covid-19 pandemic situation in the  country the  complainant could  not  met  his advocate and at   the same  time  he was  suffering   from  various  ailment   and  could not  filed  the petition  at  that time.  It is  submitted  that  on 05/09/2020  the petitioner  met his  lawyer   and  prepared  his case  and  filed the same on  21/09/2020 . It is  submitted  further  that  there is  no  deliberate   intention  for  not  filing  the  case in time &  there is  a delay  of 156 days  in filing  the  complaint   petition  by the  complainant.

                Against  the aforesaid   condonation of delay  petition   , the  opp. party  no-1 & 2   filed  objection  in affidavit   stating  that  the  averments made in the   condonation of delay petition are  contrary  and  inconsistent   with the  record  of the  case . It   is further  submitted  that  almost  2 years  have  passed  since  the claim   was  repudiated  on 10/04/2018.  It is  submitted  further   that the  complainant is  not  diligent in  persuing the matter  after repudiation  and  consumer  complaint was  filed  with  malafide  intention  to harass  the    opp. party . The opp. party   further  submits  that  the   ground stated   by the  petitioner / complainant is  not  acceptable  and  prayed  for  condonation  of delay  petition to be dismissed.

                After due hearing  we  are of the considered  view   that  the  lockdown  started  in the  last part of  March, 2020  &  the pandemic  situation  continued  and  there were  distraction  of   communication  and  movement . The  pandemic  situation  continued   for  more  than 6 months  and our usual works were   paralised. Under the above  circumstances  delay of filing  the    complaint  is found    genuine  & sufficient  & hence   condonation petition is allowed  considering the   Covid-19  situation  prevailing   in the  country. With the   above  observation mis. case is disposed off & original  petition  be  taken up  for  admission hearing
