- The Complainant is a customer of the Opposite Party Bank having A/c No. 31854222807. On 26/07/2011 a fixed deposit of Rs.50,000/-(Rupees fifty thousand) only was made and the Opposite party granted receipt No. SD/A/82 978572. The fixed deposit was for eight years and maturity value Rs.1,08,058/-(Rupees one lakh eight thousand fifty eight) only on 26/07/2019. The Complainant when placed his claim before Opposite party, the Opposite Party kept the receipt but did not pay the maturity value or deposit the maturity value in his account. After several request also when the Opposite party did not respond then on 10/07/2020 a pleader notice was issued. It is the contention of the Complainant that the Opposite Party is deficient in its service and harassed the Complainant.
- The Opposite Party after several notice also did not turn up, accordingly on 17/09/2022 set exparte.
- Perused the documents filed by the Complainant. On 26/07/2011 the Opposite Party Bank issued fixed deposit receipt No. SD/A 82 978572 having A/c No. 31854222807. The term period was up to 26/07/2019 @ 9.75% and maturity value Rs.1,08,058/-(Rupees one lakh eight thousand fifty eight) only. The Complainant has filed Advocate notice dated 10/07/2020 and postal registration receipt and acknowledgement. After receipt of the notice also the Opposite Party did not turn up. Being aggrieved the Complainant filed this Complaint.
- The Opposite party has granted fixed deposit receipt of Rs.50,000/-(Rupees fifty thousand) having receipt no. SD/A 82 978572 and A/c No. 31854222807 accordingly as a Consumer this Complaint was filed. The Opposite Party did not pay the maturity value to the Complainant or deposit in his account immediately after the date of maturity on demand which amounts to deficiency in service. The Opposite Party has also not given any reply why the maturity value was not disbursed.
Accordingly, the following Order is made:-
O R D E R
The Complaint is allowed exparte against the Opposite Party. The Opposite Party is directed to pay the maturity value of Rs.1,08,058/-(Rupees one lakh eight thousand fifty eight) only within one month along with 7% interest P.A. w.e.f. 27/07/2019 to the Complainant. In case of nonpayment the amount will carry 12% interest P.A. till realization. For the harassment and mental agony the Opposite Party is directed to pay Rs.20,000/-(Rupees twenty thousand) only compensation and litigation expenses of Rs.5000/-(Rupees five thousand) only to the Complainant.
