Shri Santosh Kumar Ojha, President In-Charge :- The complainant’s case in brief is that the complainant had deposited Rs.21,600/- only as fixed deposit on dtd.28.06.2012 at the branch of O.P. The said fixed deposit got matured on dtd.28.06.018 for which the complainant was entitled to get Rs.48,816/- only as maturity amount. After maturity date the complainant asked several times for his said maturity amount but on several requests the O.P agreed to pay Rs.43,000/- only after deducting Rs.5,816/- only to the complainant towards TDS without TDS certificate. The complainant filed this case to get his maturity amount of Rs. 48,816/- only along with compensation.
On receiving notice the O.P. kept silent even after providing opportunities and stand ex-parte ultimately.
Heard from the complainant, gone through the case record. The complainant had deposited Rs. 21,600/- only as fixed deposit on dtd.28.06.2012 with the O.P under “Q Shop Plan – H” vide Certificate No. 562016965312 issued by the O.P. The complainant approached many times to the O.P for his maturity amount of Rs. 48,816/- only but the O.P agreed to pay Rs. 43,000/- only and that to after three months after deducting Rs. 5,816/- only towards TDS without TDS Certificate. On contest, the O.P kept silent and failed to even appear before this Hon’ble Forum which reveals that he has nothing to say in this case.
Not refunding of maturity amount after its maturity and making harassment to consumer is bad in the eye of law which amounts to deficiency in service and unfair trade practice towards depositor(s).
In the above facts and circumstances the complaint petition is hereby allowed on merit by directing the O.P.to refund Rs. 48,816/- (Rupees forty eight thousand eight hundred sixteen) only towards maturity amount to the complainant without deducting any TDS alongwith pay a sum of Rs. 5,000/- (Rupees five thousand) only towards harassment , mental agony and cost of the case within 30(thirty) days from date of receipt of this order , failing which the O.P shall be liable for interest @12% per annum on the abovementioned awarded amounts till its realization.
Accordingly the case is disposed of.
Order pronounced in the open court today the 18h day of December’ 2019 and copy of this order shall be supplied to the parties as per rule.
