        The case of the complainant in brief is that the complainant deposited the amount of Rs.2,73,000/- in fixed deposit scheme of o.ps. and also opened a recurring deposit and paid an amount of Rs.40,000/- on different dates. The complainant after the maturity period asked the o.ps. for refund of the amount, but o.ps. did not pay any heed, for which the complainant filed this case praying for direction upon the o.ps. for refund of the amount of Rs.3,13,000/- in all as well as compensation and litigation cost.

            In spite of receipt of notices the o.ps. did not contest this case by filing w/v and as such, the case has proceeded ex parte against them.

            The complainant in order to substantiate her claim filed some documents including the certificates issued by o.ps. It is also found from the materials on record that after the maturity period the complainant demanded the amount from o.ps. but o.ps. did not pay any heed. The complainant before filing of this case sent a letter to o.ps. demanding the said amount, but no fruitful result was achieved for which the case was filed.

            The complainant has not adduced any evidence, only by filing a petition stating that the petition of complaint be treated as evidence. Since o.ps. did not contest the case, as such, the evidence adduced by the complainant has remained unchallenged, therefore the contention of complainant is hereby accepted. In view of the said fact we hold that there is gross deficiency in service on the part of o.ps. and the complainant will be entitled to get the relief. Thus the case is disposed of accordingly.

            Hence, ordered,

            That the CC No.52/2019 is allowed ex parte with cost against the o.ps. The o.ps. are jointly and/or severally directed to refund the amount of Rs.3,13,000/- (Rupees three lakhs thirteen thousand) only to the complainant along with compensation of Rs.20,000/- (Rupees twenty thousand) only for harassment and mental agony and litigation cost of Rs.5000/- (Rupees five thousand) only  within 30 days from the date of communication of this order, i.d. an interest @ 8% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
