ORDER

The case of the complainant is that the complainant lodged its claim with the OPs insurance company in February, 2017 but despite lapse of approximately 10 months  the claim of the complainant has not been settled. 

                        As per provision of IRDA  the OP is required to decide the claim of the complainant within three months. However, in the instant case the OP has not acted as per guidelines of the IRDA.    Therefore, the OP is given one opportunity to decide the claim of the complainant.  Accordingly the OP is directed to decide the claim of the complainant within one month from today. Since the OP has not decided the claim of the complainant as per guidelines of the IRDA it is burdened with cost of Rs.2000/- to be paid to the complainant.  Accordingly the complaint is disposed off.  

                        In case the claim of the complainant is not decided within the period stipulated above the OP shall be liable to pay additional amount of  Rs.5000/- to the complainant as compensation.

                        However,  if the complainant is not satisfied, he would be at liberty to file a fresh complaint.

                        Certified copy be sent to the parties free of charge. After compliance file be consigned.
