The advocate of the complainant has filed a petition to withdraw the complainant on the technical grounds. We have heard him. Perused the petition filed by him under order 23,Rule 1 of C.P.C. Both the opp.parties are absent. It is submitted by the learned counsel of the complainant that O.p No.2 was the nominee where as the complainants are the legal hairs of the deceased. The Complainants wants to add the name of the  O.p No.2 in the column of the complainants. It is also submitted to grant a leave to file the complainant afresh.

                 In the above circumstances the petition filed by the complainant is allowed. As per principle of natural justice the complainant is allowed to with draw the present complainant. Leave is granted also infavour of the complainant to file fresh complainant as per provision within 30 days from the date of receipt of this order.

                 The C.C. is closed being withdrawn by the complainant . Supply free copies of the order to both the parties.
