By SRI.K. VIJAYAKUMARAN ACHARY, PRESIDENT. This is an application filed by the opp.party in the complainant challenging the territorial jurisdiction of this Forum to entertain the complaint. According to the petitioner the complainant has no cause of action to file this complaint before this Forum. It is stated that the opp.parties herein are stationed at Thiruvananthapuram . The complainant was employed at Jeddah, K.S.A and he returned from Jeddah to Thiruvananthapuram . At the time of the journey from Jeddah, he entrusted all his baggages to 1st opp.party’s Airport Office there. But when the complainant arrived at Thiruvananthpuram Airportit was noticed that one of the baggage was missing. The complaint has approached this Forum claiming compensation due to the loss of his baggage. The opp.parties have no branch office at Kollam or carries on business here or personally work for gain in Kollam. Therefore this Forum has no jurisdiction to entertain this complaint. The complainant/Respondent contend that the Forum has territorial jurisdiction to entertain the complaint, as the complainant is residing at Kollam. Heard both sides. It may be seen that the Opp.parties to this complaint are not having any office or branch office at Kollam or they carries on any business or personally works for gain in Kollam District. Moreover the Opp.parties are not actually and voluntarily resides in Kollam District. The complainant has not pleaded any cause of action to show that this Forum has jurisdiction to try this complaint. The Opp.parties herein are not having any connection with Kollam District. Hence we are satisfied that this Forum has no territorial jurisdiction to entertain this complaint. Hence return the complaint for presentation before the proper Forum.
