Being aggrieved and dissatisfied with the final Judgment and Order dated 27.03.2018 passed by DCDRC. Purba Medinipur dismissing the case in complainant case being No.370/2017 against the Opposite Parties Appellant/Complainant filed the Appeal.
Perused the impugned Judgment and Order along with the materials on record.
It appears from the impugned Judgment that the Complainant filed evidence on affidavit and against that questionnaire had also been filed by the Opposite Parties.
It appears from the record that the Opposite Parties did not file any evidence on affidavit. So we are of the view that an opportunity should be given to the parties to present their case before the Commission below.
So, in view of the aforesaid observation we are of the view the Appeal should be allowed and the necessary order should be passed.

O R D E R E D
The Appeal being No.399/2018 is allowed on contest.
The impugned order is set aside.
Parties are directed to appear on 26.11.2024 before the DCDRC, Purba Medinipur.
Opposite Parties/Respondents are directed to file evidence on affidavit on date of appearance.
After their date of appearance Ld. Commission is requested to dispose of the case in accordance with law.
Thus, Appeal is disposed of.
