ORDER | ORDER NO. 6 DT. 07.03.2011 HON’BLE JUSTICE MR. P.K.SAMANTA, PRESIDENT Revisionist through Mr. R.K.Chaumal, OP No. 1 through Mr. S.P.Basu and the OP No. 3 through Mr. Sandipan Guha, Ld. Advocates, are present. Heard the Ld. Advocates for the parties in full. Judgement/order is passed as under :- This Revisional Application has been directed against the order dt. 4.5.10 passed in CDF Case No. 180 of 2007 by the concerned District Forum. By the impugned order the order dt. 3.4.09 as passed by the Forum below was modified as the said order was considered to be a futile one. The complaint case was filed by the Revisionist upon contention that the complainant approached the Ops/Bank for sanctioning a loan, for which certain documents were deposited with the Ops/Bank. Although the loan was not sanctioned to the complainant, but the original documents that were allegedly deposited with the Ops/Bank, were not returned back to the complainant. In the above petition of complaint the substantive prayer had been made for return of the original documents allegedly deposited with the Ops/Bank. Since the entire relief prayed for in the complaint is for return of the original documents allegedly handed over/deposited with the Ops/Bank for sanctioning the loan in favour of the complainant and further, since the loan admittedly had not been sanctioned in favour of the complainant, the issue that may arise for the purpose of disposal of the complaint case is that, whether the original documents, if any, were deposited by the complainant with the Ops/Bank and if deposited, whether the same has not yet been returned to the complainant by the Ops/Bank.
Therefore, at this stage, question does not arise for returning the documents, if any, allegedly handed over to the Ops/Bank by the complainant. We, therefore, do not find any illegality and/or any irregularity in making of the impugned order. The Revisional Application is thus dismissed. Since the complaint case is pending since 2007, the District Forum is requested to dispose of the same as expeditiously as possible, preferably within a period of six months from the date of communication of this order. | |
