Record is put up as per prayer of the petitioner. By a separate application, petitioner prays for dismissal of his case on the ground of no prosecution stating, that he does not want to proceed with the matter.

          Petitioner, Sri Bholanath Bhowmik, is examined as PW1. OP has not yet been appeared.

          As per the petitioner, the matter has been amicably settled between the parties and they don’t want to proceed any further. Petitioner prays for dismissal of the case this day.

          Perused the evidence. In view of the prayer of the petitioner, it is, 

ORDERED

          that the consumer case being no. CC-02/2011 be and the same is thus dismissed for non prosecution.

          Fixing of date on 12.05.2011 is thus hereby modified.
