Complaint is against the non-indemnification of the loss sustained to him on account of an accident caused by his vehicle bearing Reg.No.KA 21/8596 which is duly insured with opposite party No.1. According to complainant his vehicle hit on an electric post owned by opposite party No.3, Kerala State Electricity Board and they levied a sum of `28,827/- from him towards the cost of that pole. Subsequently when he made a claim for the said amount opposite party No.1 refused to indemnity the loss. Hence the complaint.
2. Opposite parties 1 & 2 took a contention that the insured/complainant had not intimated the accident within the prescribed time. Hence they could not send a surveyor to assess the damages.
3. Today when the case is taken up for hearing both sides filed a joint memo stating that the opposite parties agreed to settle the case for `28,827/- as full and final settlement of the claim.
Therefore the complaint is disposed as settled and the opposite parties No.1 & 2 are directed to pay `28,827/- to complainant within 30 days from the date of receipt of copy of the order. In the circumstances there is no order as to costs. Opposite party No.3 is exonerated from liabilities.
