Today is fixed for filing written version and vokalatnama by fresh step Upon OP-2 by the complainant.
Ld. Advocate for the complainant today files an application stating that the complainant has received the treatment expenses from OP - Insurance Company and the same has been disbursed in the bank account of the complainant. The complainant is also satisfied with the amount disbursed by the Insurance Company and the claim of the complainant has been fully and finally settled by Insurance Company. So the complainant is not intending to proceed with the present case further and the prayer is made to pass appropriate order by disposing of the present case for non-prosecution.
Ld. Advocate for the OP-1 also files a petition stating that the claim of the complainant has been settled by way of settlement at Rs. 36,306=00 against her claim of Rs. 37,945=00 towards her Medical Management and the said sum has been duly paid and thus the instant case is liable to be disposed off on full satisfaction accordingly.
As the complainant by filing petition stating that she has already received the claim amount through settlement and is not willing to proceed with the present case further, this Forum is of the opinion that the prayer of the complainant should be allowed.
Hence, it is

that the present Consumer Complaint being No. 205/2018 be and the same is disposed of for non-prosecution without any cost.
Let the plain copies of this order be supplied to the parties free of cost as per provisions of Law.
