Brief facts of the case:-

Case in hand is the allegation of  deficiency in service and unfair trade practice by the O.Ps  for  not  payment of  fire insurance claim Rs.1,00,860/- towards  policy  No.345490 / 48 /2018 / 16 Dated.16.05.2017 which  the complainant sought  redressal.

            On being noticed the  O.Ps appeared through their learned counsel Sri  J.K.Mohapatra but  not  choose to file  written version    resultant made exparte.  

Heard from the  learned counsel for the complainant.  Perused the record, documents,  filed by the  complainant.

That the complainant had availed  the service of the O.Ps by  subscribing one Insurance policy bearing   No.345490 / 48 /2018 / 16 Dated.16.05.2017 by paying  a premium of Rs.8,407/- which covers his stock in trade in the IMFL shop by  the side  of  Umashankar Theatre, in  New Colony of Rayagada amounting  to Rs.20,00,000/- (Rupees twenty lakhs)only  against  Fire and  Special perils including burglary and house breaking(Copies of the policy is available in the file which is marked as Annexure-I).  The  policy was valid from 16.05.2017 to midnight 15.05.2018.  During  subsistence of the policy,  a fire broke out in the premises  as above on Dt. 27.01.2008 at about 3.45 A.M.  Fire  brigade was informed  and the  fire brigade controlled the fire,  but an inventory of  Rs.1,00,860/- (Rupees one lakh  eight hundred sixty)only  had already been damaged (List of Inventory damaged  is available in the file which is marked as Annexure-2). The matter was  reported to the police station which is entered in their general diary bearing  No. 017  Dt.27.01.2018(copies of the  same  is available  in the file  marked as Annexure-3) and Fire Officer, Rayagada also  had supplied  a certificate to the  incident which is available  in the file marked  as Annexure-4).  The complainant  had informed the incident to the O.P. and  the O.P.  had deputed one surveyor on Dt. 30.01.2018. The Surveyor came and took note of  the incident, gathered all the documents, prepared the inventories list and estimate.  The Surveyor had also took signature  of the complainant  on certain papers.  The complainant had also filed his claim of insurance for damaged  inventories valued  Rs.1,00,860/- (Rupees one lakhs  eight hundred sixty)only  before the surveyor of the O.Ps. Till date the O.Ps have not  paid the above  amount to the complainant.

We find there is gross deficiency  in service on the  part of O.Ps.   

To meet the  ends of justice    the following order is passed.

In  resultant the complaint petition  stands  allowed  in  part against the O.Ps. 

The O.Ps are   ordered  to pay claim  of insurance for damaged inventories  valued  Rs.1,00,860/- to the complainant as per the  damaged  list submitted by the complainant towards policy No. 345490 / 48 /2018 / 16 along with  interest  @ Rs.9% per annum  from the date of filing of this C.C. case i.e. Dated.29.12.2018  till realization.  Parties  are left to bear their own cost.The entire directions shall be carried out with in  45 days from the  date of receipt   of this order.   Parties are left to bear their own cost.

Miscellaneous  order if any  delivered by this  commission  relating to this case  stands vacated. 

 A copy of this order be provided to all the parties at  free of cost as mandated by the Consumer Protection Act,  2019 or they may download same from the confonet.nic.in to treat the same as if copy of order received from this Commission.
