The case is fixed for argument .

Ld advocate for the O.P/The new Indian assurance company Ltd is present to argue the case but no step is taken by the complainant    who is found absent without taking any step for a long time past.

However the commission decides the case in absence of the complainant under section 38(3)(c) C.P.  Act 2019.

The complainant purchased a Health Insurance Policy for his family on 11/08/2010 policy no being 512106 for Rs. 30,000/- per family and Rs 15,000/- for indivisual member. Medical claim of Rs 19862.70 was preferred before O.P on 20/04/2011 for his treatment in Astha nurshing Home during 15/03/2011 to 23/03/2011 . But  O.P did not accept the claim and offered a cheque of RS. 4,550/- dated. 18/09/2012 which  was declined by the complainant . Hence this case.

The O.P contested the case by filing written version contending interalia  that the complainant is entitled only Rs. 4,550/- in proportionate to the assured value of Rs 15,000/- according to terms and condition of the policy .

Having regard to the fact of the case and the policy contact  the Commission is of the view that the complainant can not get more than Rs. 4,550/-.

                                        Hence it is ordered......

that the case is allowed  in part on contest .The O.P is directed to pay to the complainant Rs. 4,550/- within one month from this date in default the same may be realised through execution process .

Both parties be supplied copy of this order free of cost.
