       The complainant is present by filing hajira through Ld. Advocate. The complainant has filed a petition praying for permission  to withdraw the case with a liberty to sue afresh.                  

         The petition is taken up for hearing. Perused the petition and other materials on record. Heard the Ld. Lawyer for the complainant.

          On perusal of the petition of complaint, we find that  there are some technical defects as a result of which the case may fail. So the complainant must get an opportunity to withdraw the present case and to file a fresh petition of complaint on the same cause of action. Accordingly the petition is considered and allowed.

        Hence it is

ORDERED

        that the consumer case no. 42/2017 be and the same is withdrawn with a liberty to sue afresh on  the same cause of action within 30 days from this day. The case is thus disposed off.

         Let a plain copy of this order be supplied to the complainant. Let the documents and the extra sets filed by the complainant be also returned to the complainant on proper receipt.
