Final Order / Judgement

Delay in payment of insurance claim for medical treatment of the complainant has galvanized the complainant to lodge this complaint for redressal u/s 12 of the C.P Act 1986.

The complaint in brief may be reproduced as follows. The complainant aged about 85 years is a mediclaim policy holder under the OP-1. He had to go on sustained treatment for his eye problem being hospitalized at Disha Eye Hospital, Barrackpore, North 24 Parganas . The said eye treatment centre is under coverage of the policy. The complainant during the policy period in 2017 had his eye treated being hospitalized on 27.06.2017 and 19.07.2017. He had submitted his claim for Rs.15,158/- with all necessary documents to the OP-1 through OP No.2 on 11.07.2017 further he submitted another claim for an amount of Rs.30,679 on 31.07.2017. But till the lodging of the instant complaint i.e. 11.01.2018 the claim has not been settled by the OP-1 & 2. Being aggrieved the complainant had prayed for a total amount of the claim value i.e. Rs.45,387.00/- with a compensation of Rs. 20,000/- (Twenty thousand) and litigation cost Rs. 10,000/- (Ten thousand).

The OP – 1 & 2 in their written version on 22.02.2018 stated to this Forum that the amount of Rs. 30,679 has already been paid to the complainant and the another claim of Rs. 15,158/- is likely to be settled shortly.

On argument the learned lawyer for the complainant admitted the receipt of Rs. 30,679/- but the another claim of Rs. 15,158 is yet to be settled. As alleged that this long process of reimbursement is willful fraudulent task of the Ops.

 The Ld. Lawyer for the Ops on argument stated there is no mala fide intention to repudiate the claim but so many checkings are to be made before final payment and this is the process of settlement of any claim. But the last claim of Rs. 15,158 is going to be settled sooner.

     On 22.05.2018 the Ld. Lawyer for the OP stated to this Forum that the final payment has already been made. The Ld. Lawyer for the complainant admitted it and declined to accept the compensation and litigation cost as originally claimed in the complaint. The claim amount has been received by the complainant to his full satisfaction.

Hence, it is

                                                O R D E R E D

The case be and the same succeeds on contest, but no cost is imposed as the complainant has received the original insurance claim to his full satisfaction and withdraws all other claims.

            Let a plain copy of this order be furnished to the parties forthwith free of cost.
