            The per-litigation case is taken up for hearing in presence of both sides. After discussion over the matter in between both the parties and the members of this Bench, the dispute between the parties has been amicably settled and it is hereby –

AWARD

Today both sides have taken steps and are represented by their respective Ld. Counsels. The matter has been amicably settled in between the parties on a stipulation that the complainant/petitioner will get new furniture worth rupees 1,57,000/- (Rupees one lakh fifty seven thousand) only. The complainant/petitioner will select the new furniture on 26.03.2023 at any of the Kolkata Shops of the Opposite Party. If the price of the selected article/articles become less than that of the stipulated amount of Rs. 1,57,000/-, then the opposite party namely Mobel India Pvt. Ltd. will issue credit note in favour of the complainant/petitioner for the balance  amount  and if the price of the selected article/articles exceeds the stipulated amount of Rs. 1,57,000/-, then complainant/petitioner is bound to pay the excess amount before receiving the article/articles. The opposite party namely Mobel India Pvt. Ltd. Is directed to ensure the delivery of the new articles/articles at the doorstep of the complainant/petitioner at their own cost within 06.04.2023 positively. The complainant/petitioner is directed to return the previous item to the delivery personnel at the time of receiving the new article/articles and fully co-operate with them at the time of handing over the previous article/articles.

            Hence it is ORDERED

That the complainant case is allowed by way of steelement through “MADHYASTHATA DIVAS”.

Let this Order be kept with the original record and certified to be true copy of this order be served to both the parties free of cost. Compromise/settlement petition do form part of this order.

Thus, the matter is finally settled and disposed of accordingly.
