2.      Ld. Counsel for the appellant has suffered separate statement to the effect that he does not want to pursue the present appeal and he be permitted to withdraw the same.

3.                That in view of the statement suffered by Ld. Counsel for the appellant, present F.A. No.438 of 2023 is hereby dismissed as withdrawn and it is ordered accordingly. File be consigned to the records.

 

4.                Let, original documents be returned to the parties after getting photocopies of that documents from them against proper receipt and as per rules, after noting down in the registered, if maintained.
