Order No.7, dated 20-04-2022

Complainant is present by filing hazirah.

O.P files a petition stating inter-alia that the Complainant settled the matter with O.P, LICI on a final payment of Rs.25,000/-. Accordingly, the O.P today files a cheque bearing No.084248 dated 17.03.2022 drawn on IDBI Bank, Ukilpara, Main Road, Jalpaiguri-735131. The O.P files a petition stating inter-alia that the case has been settled out of the court between the both parties and accordingly the Complainant has received a cheque of the same number and date as aforesaid for sum of Rs.25,000/- from the O.P on 20.04.2022. Therefore, the Complainant submitted that she does not want to proceed with the case further and wants to withdraw the same.

Perused the case record and petition of both the parties alongwith the documents filed by them. Heard submission of both the parties considered.

Identity of the Complainant is verified alongwith her Voter ID Card. It appears that the identity of the Complainant is correct and proper. The Complainant has also informed to this Commission that she has received a cheque of Rs.25,000/- bearing No.084248 dated 17.03.2022 drawn on IDBI Bank, Ukilpara, Main Road, Jalpaiguri today. Now she wants to withdraw the case and she has no further claim against the O.P, LICI, Cooch Behar Branch.

The said submission of the Complainant is voluntary and unconditional. Therefore, the petition of the Complainant to withdraw the case deserves to be allowed.

Hence, it is ordered,

            That the complaint case bearing No. CC/5/2022 is dismissed for non-prosecution on contest without cost.

Let the copy of this order be sent to the parties free of cost.
