Order No.15                                                                              Dated:-20/03/13

                 Both parties file lawyers hazira.

Today is fixed for hearing. Ld. Lawyers for the parties submit that the parties shall not adduce any oral evidence and the case may be heard and disposed of on the basis of the pleadings of the parties and the documents filed.

Accordingly the case is taken up for hearing. Hd. Ld. Lawyer for the parties at length.

The present case is for a non payment of the accidental benefit. Admittedly Ranjit Ghosh was the policy holder who died in a road traffic accident. The complainant has duly received the sum assured in the policy from the Op-Insurance Company. But according to the complainant he has not been paid the accidental benefit as per policy. The main ground of objection of the Op-Insurance Company is that, the complainant has not supplied the required documents to show that Ranjit Ghosh allegedly died an accident.

Upon such facts and circumstances, we dispose of the present case with direction to the complainant to supply the relevant documents6 to the Ops. showing that Ranjit Ghosh died in road traffic accident and within 45 days of received of such documents the Ops. shall settle the claim of the complainant reasonably.

Thus the case is disposed of accordingly.

Parties be supplied the copies of this order free of cost.
