JUDGMENT
The curx of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non payment of LIC death claim assured amount to the nominee/legal heir for which the complainant sought for redressal of the grievances raised by the complainant.
On being noticed the O.P. No.1 filed written version through their learned counsel and refuting the allegation levelled against them. The O.P No.1 taking one and other pleas in the written version sought to dismiss the complaint as it is not maintainable under the C.P. Act, 1986. The facts which are not specifically admitted may be treated as denial of the O.P No.1. Hence the O.P No. 1 prays the forum to dismiss the case against them to meet the ends of justice.
The O.Ps appeared and filed their written version. Heard arguments from the O.Ps and from the complainant. Perused the record, documents, written version filed by the parties.
This forum examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties & vehemently opposed the complaint touching the points both on the facts as well as on law.
FINDINGS.
On perusal of the written version filed by the O.P. No.1 it is revealed that in para -5 the O.P. No.1 clearly mentioned that taking all the facts in to consideration, the Divisonal office vide ref No. BDO/claims/ADM/24 DTd. 25.4.2017 has issued a letter to the Branch office that the death claim under the said policy has been admitted by the competent authority for sum assured on Death plus VB less dues if any, in favour of the nominee. With the directions of the claims Deptt. Divisional office, Berhampur, the Branch office i.e. the O.P. No.1 has settled the death claim of the DLA- Indira Vegad and paid Rs. 93,971.00 to Sri Bhaskar Kumar Amar Singh, the nominee on Dt. 24.5.2017 through NEFT payment vide claim payment voucher No. 3316 favouring Sri Bhaskar Kumar Amar Singh, A/C No. 0741104000041450 IDBI bank Ltd., Rayagada.
This forum observed after receipt of notice the O.P. No.1 promptly settled the matter and credited the death claim amount in the account of the complainant bearing A/C No. 0741104000041450 IDBI bank Ltd., Rayagada on Dt. 24.5.2017 through NEFT payment vide claim payment voucher No. 3316 a sum of Rs. 93,974.00.
This forum found there is no deficiency in service on the part O.P. No.1 as the O.P No.1 has credited the death claim amount in the S.B. account of the complainant.
Accordingly the case is closed without cost and compensation.
