1. Complainant’s case in brief is that he purchased Jeevan Saral Policy No. 541317022 of LIC on 13.03.2009 and its date of maturity was 13.03.2019. The premium of the policy was Rs. 1021/- per month to which complainant paid for 10 years, in this way he paid total Rs. 1,22,520/- to the LIC and on maturity of the policy he submitted the policy paper and other documents for its payment but instead of paying the maturity value Rs. 2,50,000/- only Rs. 1,16,632/- was paid which was less to the tune of Rs. 1,33,368/-. Hence for payment of said Rs. 1,33,638/- complainant requested the O.Ps. having no impact thereafter legal notice was sent on 15.04.2019 which was also not replied, thereafter this case has been filed for redressal of grievance of the complainant.
2. On issuance of notice O.Ps. appeared by filing Vakalatnama on 21.04.2022 but they have not preferred to file W.S. hence this case is being proceeding against O.Ps. without W.S.
3. On perusal of the papers submitted by the complainant it appears that complainant has filed photo copy of the policy bond, photo copy of legal notice and photo copy of first premium receipt. All papers produced by the complainant are disclosing the facts that sum assured is Rs. 2,50,000/-. It is apparent from photo copy of paper dt. 13.03.2019 bearing stamp of the LIC as well as photo copy of the passbook of complainant related to his bank account of Bank of India, that only Rs. 1,16,632/- has been paid to the complainant who has already paid premium Rs. 1,22,520/- to the O.Ps. It is apparent that the total amount which was deposited by the complainant has also not been returned. As per complainant Rs. 1,33,368/- was due with the O.Ps. for which complainant was entitled but it has not been paid to him. On the other hand there is no any contrary material or evidence of the O.Ps. to prove that there action related to payment of only Rs. 1,16,632/- is justifiable. Therefore, we are of the view that there is deficiency in service by the O.Ps. by making less payment of Rs. 1,33,368/- which was also payable to the complainant.

In the result this case is allowed and O.Ps. are directed to pay Rs. 1,33,368/- more to the complainant within 60 days from receipt/ production of the copy of this order and in case of failure they shall pay interest @ 10% per annum from 13.03.2019 (i.e. the date of maturity of the policy) till its realization. Further O.Ps. are directed to pay Rs. 10,000/- compensation to the complainant within above mentioned period.
